The present Privacy Policy complements other contractual provisions and information that may be provided by Andrade & Gondar to its clients, as well as the other policies and regulations that are created for data protection.
Andrade & Gondar in relation to the treatment of your personal data
The controller will be Andrade & Gondar that provides you with the service and offers products, which in that context decides which data is collected, the means of processing and the purposes for which the data is used, in the cases identified in point 4.
In certain cases, Andrade & Gondar will act as a subcontractor, processing your data on behalf of another entity, which will act as the controller.
In such cases, we recommend that you consult the privacy policy and other information about the processing of your data with the data controllers.
What is personal data?
Personal data is any information, of whatever nature or on whatever medium, concerning an identified natural person.
Who are the data subjects?
Data subjects are the natural persons to whom the personal data relate.
For example, as the controller, Andrade & Gondar may process personal data whose subjects are its individual or corporate clients, who contract Andrade & Gondar's services and products, its former clients and its potential clients.
What personal data are processed?
Andrade & Gondar only collects and processes the necessary personal data to provide you with a quality service, aiming to offer you the products and services that best suit your needs and to perform the services that you have contracted, and to be able to comply with its obligations as a subcontractor.
In the scope of the provision of services, Andrade & Gondar processes the following categories of personal data:
- Identification data, as applicable (name, address, place of birth, nationality, dual nationality, citizen card, gender, date of birth, telephone contact, email, taxpayer number, marital status, profession);
- Identification data of the object (property type, vehicle type);
Data handling
As the controller, Andrade & Gondar only processes personal data in the following situations:
1. Recording and proving business transactions, which includes, but is not limited to:
- responses to requests for information made by customers or potential customers;
- requests for quotations to submit proposals;
2. Monitoring the client's management, according to the client's interests;
Data Subject Rights
Right of Access
Whenever you request it, you have the right to obtain confirmation as to whether your personal data is processed by Andrade & Gondar, as well as information regarding such processing (which are the purposes of the processing, which are the recipients of your data and which are the retention periods of your data).
You also have the right to obtain a copy of your personal data being processed by Andrade & Gondar.
Right of rectification
Whenever you consider your personal data to be incorrect or incomplete, you may request that it be rectified or completed.
Right to erasure
In certain situations, you can request the erasure of your personal data. In such cases, Andrade & Gondar will proceed with the erasure of your data as long as it does not interfere with services in force.
Right to limitation of treatment
In certain cases, you may request Andrade & Gondar to restrict access to personal data or to suspend processing activities. This will happen, for example, in cases where you contest the accuracy of your personal data, for a period of time that allows Andrade & Gondar to verify its accuracy.
Right of portability
In the cases foreseen in the applicable legislation, you have the right to receive the personal data that concerns you and that you have provided to Andrade & Gondar in a structured format, of current use and automatic reading.
Right of opposition
You have the right to oppose the processing of your personal data at any time, for reasons related to your particular situation, when such processing is based on Andrade & Gondar's legitimate interest or when it is performed for purposes other than those for which the data was collected, but that are compatible with them.
You may also object, at any time and without justification, to the processing of your data for direct marketing purposes.
Right not to be subject to automated individual decisions
Andrade & Gondar does not adopt automated individual decisions, including profiling, that produce effects on your legal sphere or significantly affect you in a similar manner.
Right to withdraw your consent
In cases where the data processing is based on your consent, you may withdraw consent at any time.
In case you withdraw your consent, your personal data will no longer be processed, unless there is another ground, such as the contract or Andrade & Gondar's legitimate interest, that allows such processing.
Right to lodge complaints with the supervisory authority
You have the right to lodge complaints with the competent supervisory authority regarding matters relating to the processing of your personal data.
In Portugal, the competent supervisory authority is the National Commission for Data Protection.
